The Turkish Court of Cassation on Time Records, Overtime, and Proof
Important distinction: Yargıtay’s analysis of time records and overtime evidence is not the same legal question as the Turkish DPA’s assessment of personal-data processing.
Why time records matter
Entry, exit, and shift records can provide an electronic trace of working time. A single record does not automatically prove actual work for the entire period, overtime for every minute, or error-free data.
Evidence context
- How the record was technically generated.
- Whether corrections and access logs exist.
- Whether employees can challenge records.
- Consistency with shifts, breaks, tasks, payroll, and other evidence.
Governance and legal content
Do not state a universal Yargıtay rule without a verified decision number, chamber, case, and official text. Evidence value and KVKK compliance are separate analyses.
Conclusion
Time records can be important evidence, but their value depends on integrity, reliability, challenge rights, and the complete evidentiary context.
