Proportionality, Notice, and Retention in Employee Monitoring

Summary: The fact that a monitoring system can collect data does not mean it should. Proportionality limits purpose, data, duration, access, and decision impact together.

A three-part proportionality test

  1. Suitability: does the data help achieve the defined purpose?
  2. Necessity: can the same purpose be achieved less intrusively?
  3. Balance: is the operational benefit proportionate to privacy and rights?

Notice and retention

Employees should understand what is collected, why, who can access it, how long it is retained, what decisions it may affect, and which rights apply. Retention should reflect legal, payroll, dispute, and audit needs—not unlimited storage.

Conclusion

Proportionate monitoring addresses a defined purpose with minimum necessary data, limited duration, and controlled access. This supports both privacy compliance and sustainable employee experience.
